File cases against a bad boss with the help of DOLE?

I resigned my job as a secretary in a private company last October. I served my boss for 8 months and 20 days. My knowledge about the the Philippine law was only very basic.
Yet, I do know that I am still entitled to a monetary compensation.

I've tried to talk to my X Boss yesterday regarding this matter yet he wouldn't give me my monetary 13th month pay. He told me that he only gives 13th month pay only for a secretary that lasted for a year. Based from what I know about the law of the Philippines, an employee that lasted a month is already entitled to that kind of compensation.


Seeked help from DOLE and found out that there was more cases my X boss would be facing if I decide to file a case against him. Like:

*ILLEGAL TERMINATION (did not give me a notice)
*He does a lot of FORGERY
*OVERTIME VIOLATIONS
*MEAL BREAK VIOLATIONS
*WORKER'S COMPENSATION VIOLATIONS
*etc.........


The only problem is, I am very hesitant to file cases against him. All I want is my 13th month pay yet he doesn't comply even if contacted. I do not like the feeling of putting a person in burden.

What should I do?

Life is really complicated especially when it comes to work concerns. Like any other issues and if you are willing to pursue, you have to plan it carefully. Legal matters is very tedious, confusing, time consuming, and a burden financially. I personally do not take matters into my hand or take legal action especially when the cost of doing it is more than I will gain. I mostly charge it to experience even If I am so frustrated and mad at them. I believe that if a person have done me wrong on financial matters, it will not make me a pauper but will definitely have its consequences on the person who have done it. I pray that I have to accept things as they are, help me overcome it and help me find a better future. It is not easy but at least you will not have sleepless nights thinking of the burden of hearings and everything. Or just to make the culprit a peace of their mind, ask a lawyer (a friend if you have one) to draft a letter for you and notarized it regarding the matter. You don't have to pursue if you don't want to. At the very least, you have made them think of it. Hope this helps or if it confuses you more, your instinct will be a good way to start. Good luck.
